Agreement to terms

These Terms of Service ("Terms") govern your use of the Emissary Studio website at https://emissary.studio (the "Site") and your engagement of our video production and creative services (the "Services"). By using the Site or engaging us for Services, you agree to these Terms. If you do not agree, do not use the Site or engage our Services.

Use of the site

• You must be at least 18 years old, or the age of majority in your jurisdiction, to use this Site.
• You agree to provide accurate information in any form you submit and not to impersonate any person or entity.
• You will not use the Site to transmit unlawful, infringing, or harmful content, attempt to gain unauthorized access to our systems, or interfere with the Site's operation.

Services and engagements

Inquiries submitted through the Site (fit calls, quote requests, briefs) are not a binding commitment by either party. A production engagement, its scope, pricing, timeline, and deliverables are governed by a separate signed agreement or statement of work between you and Emissary Studio. Where these Terms and a signed agreement conflict for a given engagement, the signed agreement controls.

Intellectual property

• The Site's design, text, and branding are owned by Emissary Studio or its licensors and may not be copied or reused without permission.
• Ownership and licensing of video deliverables produced for a client are set out in that client's signed production agreement, not by these Terms.

Communications

If you submit a phone number or email and opt in to messages, our email and SMS practices (including consent, frequency, and opt-out) are described in our Privacy Policy & Messaging Terms.

Disclaimers

The Site is provided "as is" without warranties of any kind, express or implied. We do not guarantee the Site will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, Emissary Studio is not liable for indirect, incidental, or consequential damages arising from your use of the Site. Liability arising from a production engagement is governed by that engagement's signed agreement.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.

Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by the "last updated" date above.
